Settlement possibly reached in Board lawsuit

Court documents indicate a settlement has been reached in a lawsuit filed against the McCreary County Board of Education, MCMS Principal Todd Waters and former Superintendent Michael Cash.
The federal lawsuit was filed in 2018 by John and Jane Doe, on behalf of their daughter Mary in the Federal Court in London. The Doe’s contended their child was victim to bullying in the school system and District officials were “deliberately indifferent” to the actions of other students and teachers. (The Doe surname is an alias used to protect the identity of the minor child and her family).
According to a joint motion filed in the United States District Court, Eastern District in London both the plaintiffs and defendants state they have reached a settlement in the case and asked the Court’s permission to file the documents under seal due to the necessity to include the name of the child in the agreement. Since the child is a minor, the move is designed to protect the identity of the victim.
U.S. District Judge Karen K. Caldwell granted the motion to seal on January 8.
The terms of the settlement have not been disclosed, and may be included in the documents under seal.
