Hall faces charges for violating local solid waste ordinance and littering

Failure to appear results in arrest
McCreary County Code Enforcement Officer Stephen McKinney reported the arrest of Jennifer Marie Hall of Whitley City on March 23, 2023 for failure to appear. Hall was scheduled to appear in court earlier this month to face charges of criminal littering and violation of local ordinance code # 830.6 which requires mandatory garbage pick-up and proper disposal of trash. After failing to appear, Hall turned herself in and was lodged in the Knox County Detention Center. Hall bonded out and is scheduled to appear in court later this week.
Hall’s criminal littering charge resulted from trash on her property blowing onto the street and other nearby properties. The charge against Hall for violating local ordinance 830.6 resulted from her failure to sign up for garbage service, not disposing of trash in the required manner, and storing up old garbage which created a problem with rodents.
Failure to properly dispose of solid waste in the manner set forth in McCreary County ordinance 830.6 may result in a fine of ten dollars per day up to five hundred dollars for each conviction and liability for all accumulated fees. According to K.R.S. 512.070, criminal littering is punishable with a fine up to $500 and one year in jail.
Among other specifications, McCreary County ordinance 830.6 requires all McCreary County residents and commercial property owners to sign up for franchise garbage collection and mandates all waste be maintained in a way that does not provide harborage to rodents and/or vermin or create or fire hazard. The dumping of solid waste on any premise is prohibited, and burning solid waste is prohibited except in approved incinerators or unless there is a variance granted by the appropriate air pollution control agency.

A McCreary County resident has been charged with criminal littering and violation of local ordinance #830.6. As a result of not appearing in court on the charges, the resident was lodged for a short time in the Knox County Detention Center. The charge of criminal littering resulted from trash blowing into the street and nearby properties. The charge for violating the local ordinance resulted from failure to sign up for garbage service, not disposing of trash in the required manner, and storing up old garbage which created a problem with rodents.
